NYS Email privacy laws and small businesses?

If someone belongs to an organization and they are accused of suspicious activity using the groups email account and if the head of the organization goes into this persons email without their permission is it illegal in NYS?
No, it most certainly is legal. The firm does have the right to look into any traffic (be it email or website) that goes through their servers.
